Domestic Violence

Many criminal law matters concern domestic violence, and even then, unfortunately many cases go unreported as there is no physical harm done. Domestic violence can also be emotional, however, and often concern the abuse of power. This tends to make domestic violence matters rather complex, but we’re highly experienced in dealing with these kinds of cases.

Assault

Assault charges are the second most common offence in NSW Courts, coming in right after Traffic Offences, and so, we manage these kinds of cases all the time. The type of assault charge depends on the degree of harm the victim has experienced, and like domestic violence, even if no physical harm has been caused, the intent to do so is often enough. Assault falls into two categories, common assault or aggravated assault, and the penalties for the most serious – Grievous Bodily Harm – can be lengthy imprisonment.

Sexual Assault

There is a wide range of sexual assault offences in NSW, ranging from indecent exposure to aggravated sexual assault, and a maximum of one, to 20 years imprisonment. Sexual touching is the most common offence, and carries a maximum of five years in prison.

Mental Health in a Criminal Offence

We also have vast experience, and success, in defending clients accused of a criminal offence using s 14 of the Mental Health and Cognitive Impairment Forensic Provisions Act 2020 (NSW). This means if we demonstrate you to be suffering mental health impairment and/or cognitive impairment, the court can allow medical treatment to be the solution, as opposed to being penalised through the criminal justice system.
